South Africa, the “Coalition to End Sexual Exploitation SA” (CESESA) hereby submits arguments in support of the fact that a decriminalised sex industry is the worst possible policy for South Africa.

The South African Law Reform Commission is expected to release their report on Prostitution Law Reform soon. In response to several media articles promoting the alleged benefits of a decriminalised sex industry in South Africa, the “Coalition to End Sexual Exploitation SA” (CESESA) hereby submits arguments in support of the fact that a decriminalised sex industry is the worst possible policy for South Africa. We make this submission in consideration of the dire social realities in the nation and the warnings of policy failures on prostitution internationally. International studies reveal the policy of decriminalised or legalised prostitution failed wherever it was implemented. Instead of protecting the human rights and dignity of women trapped in the sex trade, decriminalised prostitution had the exact opposite effect. The policy of legalisation or decriminalisation is a gift to pimps, brothel owners and crime syndicates – the very people who mercilessly exploit women and children for profit.

A decriminalised sex industry also significantly expands prostitution rather than contain it – luring many more vulnerable women and children into a life of unspeakable sexual exploitation, abuse and misery. Despite the failures of decriminalised prostitution internationally, Amnesty International released a report supporting this failed policy. “The National Centre On Sexual Exploitation” in Washington DC responded, “Amnesty International has developed a policy document supporting full decriminalization of prostitution. Decriminalization of prostitution is one of the world’s most disastrous approaches to the sex trade because it is a gift to pimps and sex buyers allowing them to carry out their activities as mere “sex business operators” and “customers,” and normalizes the sexual violence and exploitation inherent to prostitution as a form of “work.” If approved, Amnesty’s support of decriminalized prostitution will undermine the human rights of persons in the sex trade (the majority of whom are females), and give impunity to perpetrators of sexploitation.” See Huffington Post article link below entitled, “The Framing of Gender Apartheid” http://www.huffingtonpost.com/taina-bienaime/the-framing-of-gender-apa_b_8273268.html

South African society suffers high rates of sexual exploitation and abuse of women and children. Domestic abuse of women and children are also at intolerably high rates. Considering these disturbing facts against the backdrop of soaring rates of unemployment and endemic poverty renders decriminalised prostitution in South Africa illogical, unsustainable and untenable.

“Witchcraft Suppression Act”

The SA Pagans Rights Alliance, SA Pagan Council and the Traditional Healers Association have called for a repeal of the “Witchcraft Suppression Act” – citing religious freedom discrimination.

The organisations argue that witchcraft is a legitimate religious expression – but that the practice has historically been negatively portrayed. The SALRC is therefore tasked with establishing a distinction between “good witchcraft” and “bad witchcraft” and whether the practice should be regulated.

The SALRC Discussion Paper is available Here. Please read through carefully and send your written comments to jjoni@justice.gov.za by deadline 30 April 2016. Perhaps the Christian Churches in SA can form task teams of people with knowledge of these matters to analyse and respond to this document.

Child Exposure to Porn is a National Disgrace

The South African Law Reform Commission (SALRC) has approved publication of its issue paper, “Sexual Offences: Pornography and Children” for public comment. Child exposure to porn is a national disgrace

The paper aims to explore the topic of pornography and children, particularly the exposure of children to pornography through the mass media and the use of technology to groom and exploit children.

Four areas of concern have been identified: access to or exposure of a child to pornography and child pornography; creation and distribution of child pornography; explicit self-images created & distributed by a child (sexting); & grooming of a child & other sexual contact crimes associated with pornography.

Child-on-child sexual abuse has escalated in SA as a result of early and easy exposure to pornography.

Pedophiles use pornography to groom their victims. South Africa desperately needs stricter and more comprehensive legislation to effectively regulate access to pornography to better protect children.

As the ‘National Centre on Sexual Exploitations’ in the US says, “Pornography is causing a public health crisis by not only contributing to sex trafficking, child abuse, and lifelong addictions, but also by stripping many individuals of the ability to have lasting meaningful relationships.”

Your written comments on this issue are critical. FPI has lobbied for stricter regulations on pornography because of its harm to men, women and children. We must protect children from exposure to porn.
